Koolk was arrested!!
"To gain respect online", only to lose alot in life, alot more then a simple game.

I don't understand why people fail to see that Maplestory is a business to Nexon, I guess people just don't understand and can't compute that it puts food on the table for them, or maybe they just want to deny them to feed their family, hmm... :f6:

Oh well, has to be served then.

In before "Rebel act".

In all honesty, it comes down to this:

No matter how much you manipulate the laws, and ToS, it comes down to the game is owned by Nexon, and this is a business for them. In all honesty there is nothing you can do, go try ruling to the judge, this won't look good on your side either way, because when it comes to manipulating something that a group of people or individual are using to gain profit just to live, and you manipulating it, and give it out free, then something isn't right there.

But one thing I'll note, the newspaper isn't truly clear.
Azalea Wrote:I think there are numerous ways you can twist and manipulate Nexon's TOS and free-to-play game mechanic. One could always ask the question, "What if we removed cash shop from our private servers? Would that free me from legal responsibility because I'm not stealing anything that it sold for profit at Nexon anymore, therefore I'm not stealing away from revenue." But ultimately, it comes down to the fact that Maple Story is an intellectual property not owned by you or me, but by Nexon.

I was actually coming on to post that very question as it seems that is the path that Nexon is taking, chasing individuals over "lost income".
As a side note, would Nexon be required to demonstrate the they actually lost income through this? I play a p-server occasionally and have quite a bit of Cash shop clothing on me, however I would never EVER pay for any of that in Global.
Just a quick reply, because I said I didn't want to argue over anything... :+)
Afrobean Wrote:#1: I state what I state as facts either because they are facts or because stating "I think that..." before everything is stupid. For example, "Chocolate cake is disgusting." That said, the stance that I put out about the legality of IP infringement is not a matter of personal opinion, it is a matter of fact. You can be opposed to it, and that's fine, but IP infringement is illegal, regardless of whether you understand or are even willing to admit that it's IP infringement.
Noone said that true IP infringement wasn't illegal, the only thing you and others differ on oppinion about is if in this case it -IS- IP infingement we're talking about. I don't think it is because noone copyed anything, you think it is, because that person writes own software that's compatible with software provided by Nexon, and think that's an IP breach. Again, oppionions can differ Smile

Quote:#2: Analogies do not work here, particularly hardware analogies.
I'm not the one who started with making them m8! Smile

Quote:#3: Gratis versus Libre: Read that. There is a difference between something which is free of cost, and having an open license like you're claiming is justified with anything released free of cost on the Internet.
I stay with my opinion that publicising on an internet forum about any free available data on the internet, falls under the freedom of press, this has nothing to do with licences, it's about press freedom. But ok, you can have a different oppinion about these things! Smile
First It Was Webzu After MU Private Servers.
Then Came Blizzard After Wow Private Servers

Now Came Nexon After Private Servers.

There Still Private Servers Today

MU Private Server And Wow Private Servers Are Still Going On.
So Is Development.Wink

Blizzard And Webzu Relieased That They Cant Keep Sueing As They Wasting $,So They Give Up.

I Think Nexon Will Too,How Far Will They Go. 2010 ? 2011 ?

Even They Win

Someone Somewhere In World Will Make Private Servers Again.

Just My 2 Cents.

freedom of the press protects you from the government, not the other people. and since the original intellectual property is nexon's, saying that they cant censor what you are doing with their own property is kind of pointless. its their property. one way i think of it is like this: think of nexon like a park or something, and they let you come in for free and hit in their batting cages all day free, but they ask for a donation if you want to use the really nice new bats they have, that have nothing but looks and feel better than the crappy ones they let you use. someone comes along and says, i have all these really nice bats over here, why not use them for free? nexon as the park owners, lose income and may have to close the cages, or start charging for them now.

not saying that its completely true in this sense, because its not. but since they are a business, they dont like competition offering their stuff back to them better than they distributed. they see it more like a slap to the face than an extra hand helping out. they also dont like people cutting into their wallet, imagined or really, so they will follow up on both the actual and the imaginary till they find that they feel safe and cozy again.

back to the OT: i really hope they dont try to make an example of koolk and nail him to the wall, he really did contribute a lot to the community and his loss will be keenly felt down the road.

QFT.

I wonder if Nexon would actually hire KoolK. That would make me laugh. It's just their secret way of saying "we surrender".[/COLOR]
With this kind of notoriety some companies will be falling over themselves to employ a person with his level of skill. I think he wont have to worry about employment. lol
By the way, Ilon, you might want to change the title of this thread. The article doesn't say KoolK hacked the KMS servers, it says that he was sued by the KOREAN company Nexon. Nexon is, indeed, a Korean company in it's origin.

1.Eylon, not Ilon
2.I did change.. it doesn't work for some reason.. maybe it will change it automatically..
Okay Eylon Tongue
Now I know how to write your name in english Smile
It would be more profitable if all of u coders teamed up and made a game. I would definately support you $$$ Glitter

I have a few ideas............... lol

However, I am sure Fiel and the rest of the guys know that they are playing with fire. It sure helps the community but there are businessmen who care less about us players. The rules of the game are set so there's nothing much we can do. Those of you who have ever been part of the Lineage2 extreme drama know what's all this legal thing about. Like it or not there's intellectual property over all the stuff packed in the client. Distro is nly free for nexon and for the ones who buy the rights.

Once again I say that with all the things you know about coding and your experience as gamers you could make a game 100 times better. Even if it graphically sucked i'd play it xD

Hope at least this site keeps running...

Matze and me are in planning stages for a space shooterish mmo thing. We are not very far tho and none of us is very good with art/graphics/drawning so that might make this project stay in planning stage forever Sad
But let's see... (is anyone here intersted in a fast pased space shooterish 2d-ish mmo?)
Doing 3d with java is evil too... :/ we are aiming for being cross platform and my initial tests with the jmonkey engine showed different results on 3 test systems... I guess we'll have to hack it to make it work Smile
a problem with coding your own game is what type of coding it will be made with. MS is used with the WZ files, but most likely a self made game wont be put into a container like .WZ, so it would be easy for other to take it and modify parts of it to their own ends.

Recall that this the same situation the music industry faced when mp3 downloads first hit it big. Clearly the industry was taking a hit from it, but how could a company calculate exactly how much money they lost directly as a result of a single person or group illegally giving away their music? Surely not everyone who downloaded the song would have bought it otherwise.

It's not a matter of opinion. It's a matter of fact.

And even if my statements thus far were wrong, it's still not a matter of opinion. You can't have an opinion that something is against the law or not (this is the willful ignorance someone else called you on in a previous post; ignorance to the law is not a legitimate defense). You can have an opinion as to whether it is immoral, but laws are clearcut, and in the cases where there is leeway in the understanding, the judges clearly define it once it is relevant to application of said law. Asking a person their "opinion" on if a law exists is like asking someone their opinion on whether the moon exists. Even if the moon doesn't actually exist, this is something that is a matter of fact, not opinion. Honestly, did you not go over these concepts in elementary school?

And yes, I know, ad hominem. Get off my back, this kid deserves it.

ps yeah definitely guys, rather than wasting time breaking the law and getting sued by Nexon, why not take your skills and put them to work as legitimate competition for Nexon. Build an original game of a similar concept. If the servers are that easy to maintain, you could even instill a system where you could make legitimate money off of it.

edit:

Look at how many can decrypt the WZ. You don't think that the brilliant minds of the community could employ a likewise encryption method in an original game?

And what does it matter, right? If all that would appear in the "easily" accessible data is music, strings, pictures, why does it matter? Does it hurt MapleStory to have people extracting pictures and information every time they patch?

Okay, no offence, but lern2grammar; I can't read your post without my head hurting. The only words that should be capitalised are acronyms (words such as 'lol' or 'SP' for 'Southperry.net'), proper nouns (names, titles, etc.), and the first letter of the first word in a sentence. None of this 'capitalising every first letter of every word' bullpomegranate that makes me want to beat my goddamn head against the wall when I try to read your post. I'd refer to myself as a grammar nazi for this, but with this serious of an error (re: abortion) I think (re: hope) English isn't your first language, and I'm giving you the benefit of doubt and helping you rather than my natural reaction to this sort of thing.

On the topic itself: I was never a fan of private servers, and Nexon is fully within their rights to go after these people, even if it may not be in vogue with the community. "Wah wah wah, they're so money-hungry!"--wake up and smell the coffee; they're a pineappleing business. "What's the goal of a business??" you may ask! Well, let me tell you. The goal of a business (ANY BUSINESS!) is to make money, first-and-foremost. Yes, even Blizzard, even if they do care almost as much about quality and pleasing their fanbase as they do money, they still want their money. That's why WoW is P2P. That's why their games have CD-keys. You get the idea. I'd hope.

Anyway, this all means that you people need to get this stupidly ignorant view of Nexon out of your heads and stop believing they're some disgustingly horrible conglomerate that would do absolutely anything to make a dollar and is out to personally rape and sodomise your family. They're just your average company. If you want to peach about a company, peach about Starbucks, Wal*Mart, or Microsoft.

More than that. They make good decisions as a business/company but they provide poor customer service. If you've spend money on your account and if you get hacked but never given your account info to anyone, and if you were to ask them for support, I doubt you would get any. If you continue to get the support, you might find yourself banned lol.

You'd now have a reason to hate them but still like playing maple for the sake of fun and your friends. So what can you do?

Since you tied in Walmart, if you went into Walmart complaining about a product that does not work as advertised, and they kicked out of the store, I don't think you'd shop at that Walmart again.
Again, before people go down the Walmart analogy, I'd like to point out that real world analogies do not work in this instance. The only way they would is if I was able to copy-paste a Walmart store and operate my copied instance on a minimal cost to myself, all the while using Walmart intellectual property and giving away products (which may actually be improved versions of products I'm not licensed to sell) from my copied instance free of charge.

Basically, because of the digital ability to copy without theft, real world examples fail to capture the depth of this situation. The Walmart comparison can work to reference business models, customer service and such, but as far as the topic of "private" server and IP infringement is concerned, they don't come close to being relevant.

I sincerely hope that this wasn't directed towards me.

I hope you two aren't going to argue about senseless drivel.

Back on topic, please.
Not surpised. Private servers ruined a lot of online friendships in the real server. I lost contact, and they rarely sign on, and when they do, I ask "Where have you been?" Their responce: Private server.

I'm SORT OF gald that Koolk got sued/arrested/etc, but I do feel sorry for him. He was respected in many eyes, while I felt indifferent about him. In a sense I'm gald he is gone, but Private servers were fun... For an hour.
