It's pretty well established that the ToS to the letter is more or less worthless as a measure of legitimacy. Nexon reserves the right to ban you for anything at any time. But yes, it's illegitimate to use equips that can not be made legitimately. You only have plausible deniability if you're using something that simply may have been hacked, not so with 300 atk weapons.
Banning people at this stage is absurd though, they should've taken these equips out as soon as they were created. Doing it now after months and months of otherwise legitimate players being tempted by a complete lack of enforcement coupled with huge gains from using these equips is just adding injury to insult.
