The only way they would is if I was able to copy-paste a Walmart store and operate my copied instance on a minimal cost to myself, all the while using Walmart intellectual property and giving away products (which may actually be improved versions of products I'm not licensed to sell) from my copied instance free of charge.
Basically, because of the digital ability to copy without theft, real world examples fail to capture the depth of this situation. The Walmart comparison can work to reference business models, customer service and such, but as far as the topic of "private" server and IP infringement is concerned, they don't come close to being relevant.
I sincerely hope that this wasn't directed towards me.
