Koolk was arrested!!

Koolk didn't even run a private server though, he just wrote the code. That's like arresting someone for murder because they made a gun, and then let other people use it. It's not his fault if people use stuff he makes inproperly and violate Nexon's TOS. As far as I know he didn't even distribute cracked client, just a server that could emulate the MS server. Nothing stolen from Nexon, just self developed code. Should it be illegal to reverse engineer or write code that interfaces with someone else's data, because they already wrote software to do it? That would make OpenOffice reading .doc illegal, FoxIt reading .pdf, etc.

Go have a look at the history of unlicensed gaming on the NES.

And yes, I do believe that OpenOffice and FoxIt are also unlicensed infringements, but the difference here is that Microsoft and Adobe aren't taking action. It may even be that the .doc and .pdf formats, despite being created for the software in question, were made in such a way as to not make them proprietary.

And the gun analogy is wrong in that the Bill of Rights guarantees a right to bear arms. There are limitations to this, however. For example, if I made a nuclear bomb and gave it to Osama Bin Laden, I would be held legally responsible. I can't say "oh, I only made it, he was the one who killed people with it." The fact of the matter is that he developed software to emulate the server interaction and distributed this to individuals who he knew would use it illegally.

And please, don't make me get back into this tiff about "nothing stolen" that went down in the thread about Odin. Theft is not a requirement of IP infringement.
