Those are pretty dam similar to me. Hair position, posture, arms and legs positions, the wings.

Personally, Id be more pissed at the horrible job they did copying the style and such...

To be honest, the post is pretty generic. "Angel floating down from above" isn't exactly something unique, and the hair + wing positioning is similar because that's how most people envision angels from above coming down; slow and graceful, yet their wings and hair flow up miraculously as they descend, untainted by gravity, not affected by the impurity of this world.

The difference I see is your image has her looking like she's casually away from something, while the other image has the character looking like she's coming down to the onlooker.

I dunno, while they're both similar, I certainly wouldn't say either of you copied from the other. If you had backgrounds, and the backgrounds were also similar (yet not generic) then I'd think otherwise. As of right now, they just seem similar in pose, but not copied.

I propose this. You send him/her the original saying that he/she blatantly ripped off your work and that you wish to have it taken down. It is not an exact copy, but the face is the only thing that is not the same. Mind you, there are pictures of Tinkerbell in the same position in Peter Pan I think. Perhaps you are both taking the idea of Tinkerbell and plagarizing that. Who knows. I don't think these drawings are anything other than coincidences nor do I think they are worth any amount of money. So just say what's on your mind and get it off your mind. Also, I suggest you use the following picture to show your disgust:

It's mainly why I also believe it to be a coincidence, it is a generic pose, but if it weren't for the fact that the wings, of all things, looked so similar, I wouldn't be as doubtful about it. That was pretty much the first thing I noticed when I first saw this. >_>
